Definitions
Conditions means this terms and conditions of entry for the event.
Registration Form means the website registration form which requires details to be provided for participation in an event.
Event Organiser means Tynan Motors
Registration Fee means the cost of team / individual entry into the event
Participant means the person/persons who will be participating in the named event on the entry form
Team means each and all-individual members of said team
Agent means officials, employees, volunteers, affiliations, sponsors and medical staff who are involved in managing/staging/operating of the event and associated events/activities.
Fundraising all money which has been raised and donated towards the selected event charities, SSMRF or UOW
Participations
The participant acknowledges that participation in the event is a physically strenuous activity. It is acknowledged that participation in the event is physically demanding and I am aware of the nature of the event and associated medical and physical risk involved. I am physically capable of competing in the event and agree that Tynan Motors and it’s agents are not responsible for any injury or illness that I may suffer as a result of my participation in the event.
The team agrees to abide by the rules and regulations. The participant shall not be entitled to a refund of their registration fees and donations if they are disqualified for the event as a result of an infringement of these conditions. Such event rules including limits not he time taken to complete the event that may be initiated by the Event Organiser at its discretion to ensure the safe and proper running of the event.
The participant must register their team as directed by the Event Organiser.
While the Event Organiser takes every care with the staging of the event, the participant acknowledges that personal accident insurance is their responsibility.
All team members must be aged 18 or above.
All team members agree to have signed the waiver form to be submitted at event registration as directed by the Event Organiser. Failure to do so could result in team cancellation.
Ensuring that your T-Shirt size is submitted online by the correct date (failure to submit T-Shirt size will result in the team member receiving a generic size if available on the day).
The team leader is agreeing on behalf of all members in the team to abide by these terms and conditions of entry, as well as ensuring that the minimum fundraising is met by the due date. All funds raised under the name of The Michael Tynan Memorial Challenge and its events, must be donated to the SSMRF by the final fundraising submission date.
Payment and Bookings
To successfully register for an event, the participant must complete the online registration form and pay the registration fee.
The team/participant shall not be eligible to compete in the event until the minimum fundraising has been received by due date. No payment shall be deemed to have been received until the event organiser has received cleared funds.
All registration fees and fundraising are non-refundable and non-transferrable.
Withdrawals, Cancellations and Alterations
If a team member withdraws from a team the Michael Tynan Memorial Challenge must be notified via email with information of the withdrawing team member/participant and the replacing member. If the team member change is after the T-Shirt sizing due date, non-amendments or additional shirts will be issued, with the new team member also needing to sign a waiver form.
If a full team cancellation is required, the team forfeits their registration fee and also any funds raised toward the Michael Tynan Memorial Challenge.
Notice of team withdrawal from the event must be communicated in writing via email to the event organiser. Withdrawals will not be accepted by telephone.
The event organiser reserves the right to withdraw the offer of a team place / participant in the event for any reason and at any time deemed appropriate; injury, minimum fundraising not met, breach of event rules and regulations and in such circumstances, the team/participant will not be offered a refund of their registration fee.
The event organiser reserves the right to amend and or cancel the event in consultation with and under the direction of Emergency Services agencies and major event stakeholders/landowners; however The Michael Tynan Memorial Challenge will only exercise these weights due to circumstances beyond its control (e.g. weather conditions), with all teams/individuals been notified as soon as possible. In the event of bad weather, The Michael Tynan Memorial Challenge will make all attempts to reschedule the event to an alternative date giving enough notice for participation. If the event is cancelled or you are unable to participate on the rescheduled date participating teams/individuals have the option of requesting a 50% refund their registration fee.
Publicity
The participant irrevocably consents to their appearance in the Event being filmed, recorded and incorporated in whole or in part in any television program, film, video or broadcast of whatever nature by all means and in all media and formats now or invested after the date of these conditions.
The participant irrevocably consents to the use and reproduction of the participants name, likeness, appearance and photographs, films and recording by all means and in all media for the purpose of advertising, publicity and otherwise in relation to the exploitation of the Event and/or the portion of the event and the commercial rights relating to the Event provided that such use does not imply direct endorsement by the participant of any official sponsor or suppliers of the event.
The event organiser reserves the right to vary these conditions by giving notice to the participant in writing any official Event material or correspondent prior to the Event.
Acknowledgement, Waiver and Release Form
Please read individual waiver and release forms carefully before clicking on and accepting terms & conditions and waiver and release from liability and potential claims based upon negligence or other claimed misconduct.
Walking Challenge
I understand that participating in the MICHAEL TYNAN MEMORIAL CHALLENGE (the Event) involves walking on road and rugged, isolated and often remote tracks. I am aware of the hazards involved. The hazards include, but are not limited to, road or track surfaces, remoteness from assistance or medical aid, the extremely strenuous nature of covering kilometers on foot, becoming lost, vehicle traffic, actions of participants, spectators, organiser’s personnel, supporting agencies, weather conditions, sleeplessness, hypothermia and heat exhaustion, condition of suitability of participant’s clothing, footwear or equipment. In my judgment I have sufficient competence and experience to participate safely in the Event and I understand that this event is deemed as a “dangerous recreational activity” as per 5L of the Civil Liability Act 2002.
I certify that I am physically fit, have sufficiently trained for participation in this event and have not been advised otherwise by a qualified medical person and that I have been given the opportunity by the organiser to attend the pre event briefing session.
On behalf of myself, my executors, administrators, heirs, next of kin, successors and assigns, I:
RELEASE AND DISCHARGE The Michael Tynan Memorial Challenge Event sponsors, Event producers, volunteers, community organisations and all State, Federal and Local Government authorities with responsibility for the locality in which the event may be staged and their or its respective officers, directors, employees, independent contractors, representatives, agents and volunteers (indemnified Parties) from any and all liability for death, disability, personal injury, property damage, property theft and all other loss or injury whatever and however occurring which I may suffer as a result of or in connection with, directly or indirectly, my participation in and my traveling to and from this event and I waive all and any claims against the indemnified Parties which but for the execution of this Acknowledgement Waiver and Release I may have had against the Indemnified Parties or any of them;
INDEMNIFY AND HOLD HARMLESS the persons or entities mentioned in paragraph 3(a) from any and all liabilities, claims or actions (including negligence) whatever or however caused which may be brought against them or any of them arising as a result of or in connection with, directly or indirectly, my participation in and traveling to and from this event, including any claim by my (or my teams) support crew or any person assisting me or my team.
The decision to participate is entirely my own and I accept all risks associated with participation in the event, including but not limited to loss of life or permanent injury.
I hereby consent to receive medical treatment which may be deemed necessary in any event of injury, accident and or illness during the event.
I understand that during the event or related activities I may be photographed or filmed. I agree to allow my photograph, my name, fundraising total, voice, statement, video, film likeness or otherwise to be used for any legitimate purpose by the MICHAEL TYNAN MEMORIAL CHALLENGE, the sponsors and or assigns.
I consent to the organisers of the event entering my personal details obtained on this entry form into a database which will be used by administration of the event, including SMS event information to me if I have provided a mobile phone number.
I acknowledge that I will provide emergency contact details (name and contact number) in the space provided on this event entry form and that the organisers of the event may contact that person and exchange my personal information with them.
I agree to abide by the Event rules and I understand that my entry may be voided if through my actions or behavior, in the opinion of the organisers, I break any of the rules or I bring the event into disrepute. I further understand that the organisers reserve the right reject any entry without having any justification for their actions.
I agree to use all reasonable endeavours to ensure that I and my team raise our fundraising goal stated in the rules and regulations of registration for this event and send the total of all fundraising raised to MICHAEL TYNAN MEMORIAL CHALLENGE by the requested date.
I understand that in the event of a full cancellation the team registration is non-refundable.
I hereby certify that I will be eighteen (18) years of age or older before the Event starts.
Driving Challenge
I understand that in order to participate in the MICHAEL TYNAN MEMORIAL CHALLENGE (the event) I musthold a valid drivers license and drive a registered vehicle.
I agree to abide by all NSW road rules, including but not limited to; sticking to the designated speed limited, not using my mobile phone while driving and not driving under the influence.
On behalf of myself, my executors, administrators, heirs, next of kin, successors and assigns, I:
RELEASE AND DISCHARGE the Michael Tynan Memorial Challenge event sponsors, event producers, volunteers, and all State, Federal and Local Government authorities with responsibility for the locality in which the event may be staged and their or its respective officers, directors, employees, independent contractors, representatives, agents and volunteers (indemnified Parties) from any and all liability for death, disability, personal injury, property damage, property theft and all other loss or injury whatever and however occurring which I may suffer as a result of or in connection with, directly or indirectly, my participation in and my traveling to and from this event and I waive all and any claims against the indemnified Parties which but for the execution of this Acknowledgement Waiver and Release I may have had against the Indemnified Parties or any of them;
INDEMNIFY AND HOLD HARMLESS the persons or entities mentioned in paragraph (a) from any and all liabilities, claims or actions (including negligence) whatever or however caused which may be brought against them or any of them arising as a result of or in connection with, directly or indirectly, my participation in and traveling to and from this event, including any claim by me or my guest.
The decision to participate is entirely my own and I accept all risks associated with participation in the event, including but not limited to loss of life or permanent injury. I agree that the activities may be deemed as dangerous recreational activities and I accept all responsibility and actions associated with this.
I hereby consent to receive medical treatment that may be deemed necessary in any event of injury, accident and or illness during the event.

Scooter Challenge
I understand that in order to participate in the MICHAEL TYNAN MEMORIAL CHALLENGE (the event) I musthold a valid drivers license and drive a registered vehicle.

Paddle Challenge
I understand that in order to participate in the MICHAEL TYNAN MEMORIAL CHALLENGE (Paddle event) I must be registered with a licensed club
I agree to abide by all event rules on the day as provided by the event managers and team leaders
On behalf of myself, my executors, administrators, heirs, next of kin, successors and assigns, I:
RELEASE AND DISCHARGE the Michael Tynan Memorial Challenge event sponsors, event producers, volunteers, and all State, Federal and Local Government authorities with responsibility for the locality in which the event may be staged and their or its respective officers, directors, employees, independent contractors, representatives, agents and volunteers (indemnified Parties) from any and all liability for death, disability, personal injury, property damage, property theft and all other loss or injury whatever and however occurring which I may suffer as a result of or in connection with, directly or indirectly, my participation in and my traveling to and from this event and I waive all and any claims against the indemnified Parties which but for the execution of this Acknowledgement Waiver and Release I may have had against the Indemnified Parties or any of them;
INDEMNIFY AND HOLD HARMLESS the persons or entities mentioned in paragraph (a) from any and all liabilities, claims or actions (including negligence) whatever or however caused which may be brought against them or any of them arising as a result of or in connection with, directly or indirectly, my participation in and traveling to and from this event, including any claim by me or my guest.

By agreeing to the terms and conditions of the challenge, I herby certify that I (the participant) have also read this document, and I both understand and agree to its contents.
